General terms and conditions of sale

Preamble

The online sales website www.trendethics.com is managed by the association trendethics whose head office is located at 48 rue Sauffroy, 75017 Paris, registered with the Paris Trade and Companies Register under the number 85168563600017.

It is specified beforehand that the present conditions govern the sales of its products by trendethics to any individual or legal entity making a purchase via the website www.trendethics.com, hereinafter referred to as "the CUSTOMER".

The present General Terms and Conditions of Sale, together with the order form and order confirmation constitute the sales contract between trendethics and the CLIENT for the sale of the products ordered.

Any order placed on the website www.trendethics.com requires that the CLIENT accepts the General Terms and Conditions of Sale in their entirety beforehand and without reserve.

In case of disagreement with the terms and conditions of the General Terms and Conditions of Sale, the CLIENT must not use the website.

trendethics reserves the right to adapt or modify its General Terms and Conditions of Sale at any time and without prior notice, the adaptations or modifications being then applicable to all orders subsequent to the adaptations or modifications.

In case of modification, the General Terms and Conditions of Sale applicable to the CLIENT's order are those that were online, and which the CLIENT has accepted on the day of placing the order.

Article 1 - Definitions

The terms and expressions identified by a capital letter in the General Terms and Conditions of Sale have the meaning indicated below (whether used in the singular or plural).

General Terms and Conditions of Sale: refers to the present document, i.e. the terms and conditions that apply in the relationship between trendethics and the CLIENT.

Order: refers to the CLIENT's purchase order for one or more Products or Services placed through the use of the www.trendethics.com website or via the Customer Service.

Website: means the website accessible at www.trendethics.com.

Product: shall designate a product or Service offered for sale on the www.trendethics.com website.

CUSTOMER: refers to a physical or moral person, a consumer, who uses the www.trendethics.com Website and acquires one or more Products, for his or her personal needs, having previously adhered to the General Terms and Conditions of Sale.

Article 2. Subject

The present General Terms and Conditions of Sale aim to define the contractual relationship between trendethics and the CLIENT and the conditions applicable to any purchase made through the www.trendethics.com website.

By accepting these General Terms and Conditions of Sale, you declare that you have reached the age of majority in your country, state or province of residence, and that you have given us your consent to allow any minor person in your charge to purchase on this online sales site.

The use of our products for any illegal or unauthorized purpose is prohibited.

trendethics reserves the right to modify these Terms and Conditions of Sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the CUSTOMER.

Article 3. Prices

The prices appearing on the product sheets of the internet catalogue are prices in Euros (€) all taxes included (VAT included) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products.

trendethics reserves the right to modify its prices at any time, it being however understood that the price appearing in the catalogue on the day of the order will be the only one applicable to the CLIENT.

The products remain the property of www.trendethics.com until the complete collection of the price by www.trendethics.com.

Promotional products will be indicated by a "PROMOTION" sticker or by a crossed-out price. Our promotions are valid within the limit of stocks available at the time of the order and during the display period.

For CUSTOMERS outside Metropolitan France, www.trendethics.com is obliged, in accordance with the law in force, to charge VAT on orders shipped to most countries of the European Union.

For CUSTOMERS outside the European Union and DOM-TOM, orders are not subject to VAT, but may be subject to local taxes and customs duties in force in the country of receipt. These rights and sums are not the responsibility of www.trendethics.com. They are the responsibility of the CUSTOMER.

Warning: Any inaccurate information provided by the CLIENT in order to evade VAT may result in civil fines and criminal prosecution.

The prices of the Products indicated on the www.trendethics.com website do not include processing and shipping costs, which are invoiced in addition to the price of the Products purchased and according to the total amount of the order.

Article 4. Order

The contractual information is presented in French and will be the subject of a confirmation including this contractual information at the latest at the time of delivery. The company trendethics reserves the right to cancel or refuse any order from a customer with whom there is a dispute over the payment of a previous order.

To order Products on the www.trendethics.com website, the CUSTOMER must create an account by providing the required information on the registration form.

To this end, the CLIENT declares that he or she provides complete, unerring personal information that will allow precise identification in any situation. Any fanciful or slanderous personal information may lead to the CLIENT's account being closed and the Order being cancelled.

The account creation section is accessible directly from the main menu bar. At each visit, the CLIENT, if he wishes to order or consult his account (order status, personal information...), must identify himself using this information.

Article 5. Payment

The price of the Products and the costs of logistical preparation and delivery are payable in full by the CLIENT when the Order is placed.

The www.trendethics.com website may offer the Customer the option of paying for his order by credit card. 

After validating the method of payment by bank card, the Customer is redirected to the secure interface of the payment system in order to securely enter his personal bank card references. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable.

Article 6. Right of Withdrawal

In accordance with Article L121-21 of the Consumer Code, the Customer has a period of fifteen working days from the date of receipt of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty.

The products must be returned in their original packaging, without having been used, accompanied by the initial signed Delivery Note. The return costs are the responsibility of the Customer.

Article 7. Delivery

The Products will be delivered, after registration of the payment of the Order, to the delivery address indicated by the CLIENT during the placing of the Order. An e-mail will be sent to the CLIENT to inform of the shipment of the Products. The CLIENT has the option of choosing between different means of delivery.

Shipping costs are calculated according to the delivery method chosen (home, relay point, post office, etc.), the weight of the package and the destination.

Delivery times are given only as an indication, if they exceed thirty days from the order, the sales contract may be terminated and the Customer reimbursed.

Article 8. Warranty

All products offered by the trendethics on the www.trendethics.com website benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned to the company trendethics who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by email welcome@trendethics.com or by post to the following address: trendethics, or 48 rue Sauffroy, 75017 Paris within thirty days after delivery.

Article 9. Responsibility

The trendethics association has only an obligation of means for all stages of access to the site, the order process, delivery, customer service or subsequent services. The responsibility of trendethics cannot be held liable for any inconvenience or damage inherent in the use of the internet network, in particular loss of data, intrusion, viruses, breakdowns in the service, and other unintended problems, or any fact qualified as force majeure, in accordance with jurisprudence.

The computerized registers kept in trendethics' information systems under reasonable conditions of security, will be considered as proof of communication, orders and payments between trendethics and the Client.

Article 10 - Security

The www.trendethics.com website is subject to a security system: the SSL encryption process has been adopted, but all scrambling and encryption processes have also been reinforced to protect all sensitive data related to means of payment as effectively as possible.

Article 11 - Intellectual property

All the texts, comments, works, illustrations and images reproduced on the www.trendethics.com website are reserved under copyright and intellectual property law and for the whole world. As such and in accordance with the provisions of the intellectual property code, only private use is authorised, subject to different, or even more restrictive provisions of the intellectual property code. Any total or partial reproduction of the site www.trendethics.com is strictly forbidden whether in the form of a photo, logo, visual or text.

Article 12. Personal data

All the data that you entrust on the www.trendethics.com website are entrusted to us in order to be able to process your orders. 

Under the terms of the law n°78-17 of January 6, 1978 relating to data processing, data files and liberties, you have the right to rectify, consult, modify and delete the data you have communicated to us. This right can also be exercised online.

Article 13. Force majeure

The execution by trendethics of all or part of its obligations, in particular of delivery, will be suspended in the event of the occurrence of a fortuitous event or force majeure which would hinder or delay its execution. War, riots, insurrection, social unrest, strikes of all kinds are considered as such, without this list being restrictive. trendethics will inform the CUSTOMERS of the occurrence of a fortuitous event or force majeure within seven days of its occurrence. In the event that this suspension continues beyond a period of fifteen days, the CUSTOMER will have the possibility of cancelling the order in progress, and the price of the Products ordered and the delivery costs paid will then be refunded.

Article 14. Applicable laws and competent courts

The General Terms and Conditions of Sale are subject to French law. Only the French version of these General Terms and Conditions of Sale is authentic. In the event of any difficulty arising during the Order, delivery of the Products and more generally during the execution of the sale, the CLIENT shall have the possibility, prior to any legal action, of seeking an amicable solution, in particular with the help of a consumer association or any other counsel of his choice.
